Kim Soo-hyun wins first ruling in 10-billion-won advertising dispute

Actor Kim Soo-hyun's agency, GOLDMEDALIST, has won a lawsuit seeking the return of an advertising contract deposit worth approximately 570 million won. This marks the first court decision following the private life controversies surrounding Kim, which escalated into contract terminations and large-scale civil disputes, and is expected to have a significant impact on future related litigation.

On the 27th of last month, the 13th Civil Division of the Seoul Eastern District Court dismissed all claims filed by the Swiss watch brand Mido against GOLDMEDALIST regarding the return of the contract deposit. As Mido did not appeal, the first instance ruling has been finalized. The core of this case was not the facts of the controversy itself, but whether there were legal grounds to terminate the advertising contract midway and whether GOLDMEDALIST was responsible for returning the remaining contract deposit accordingly.
The relationship between Mido and Kim dates back to 2020. Kim was selected as a model for Mido at the time and has continued the contract, and it was reported that in November 2024, a one-year contract extension was signed under the condition of receiving a 900 million won deposit.
However, the situation changed rapidly as allegations regarding Kim's private life surfaced. Mido filed a lawsuit demanding the return of approximately 570 million won, corresponding to the remaining contract period, following the termination of the contract. Their argument was that the model's commercial value had been damaged by the controversy, creating grounds to terminate the advertising contract, and that the amount corresponding to the unused period of the already paid model fee must be returned.
GOLDMEDALIST's logic was different. They argued that the issue was not caused by Kim's own contractual fault, but was triggered by revelations from a third party, which cannot be viewed as grounds for terminating the advertising contract. The court also ruled that the grounds for contract termination claimed by Mido were not established, thereby rejecting the claim for the return of the funds.
The reason this ruling is drawing particular attention is not merely because of the 570 million won amount. Kim's side is currently engaged in legal disputes with several other advertisers regarding the return of model fees and damages, with the scale of related lawsuits reportedly reaching 10 billion won. Companies such as Eider, FromBio, Classys, Cuckoo Electronics, and Trendmaker are being mentioned.
Therefore, this case served as a kind of 'first test.' Of course, this ruling does not determine the outcome of lawsuits from other advertisers. Since image damage clauses, contract termination conditions, and the scope of a model's duties and responsibilities can vary for every advertising contract, each case is likely to be judged separately.
Nevertheless, it can be read as an important precedent in the advertising industry. This ruling confirmed that just because a famous celebrity's private life becomes controversial, an advertiser cannot always unilaterally terminate a contract and demand the return of the remaining model fee.
In advertising contracts, 'image' is an intangible asset, but legal liability is a much more specific matter. The fact that a brand claims image damage is not the same proposition as the existence of contractual fault on the part of the model. Regardless of public criticism or online sentiment, the court must examine the termination grounds written in the contract, the actual facts, and the scope of the parties' responsibilities.
The controversy surrounding Kim also requires a distinction between legal judgment and public judgment at this point. After allegations regarding the late Kim Sae-ron spread last March, Kim's side refuted them and initiated legal action. Kim Se Ui, the head of Hover Lab who raised the allegations, has been indicted under detention on charges such as defamation by spreading false information. It has also been reported that the police decided not to transfer certain allegations related to Kim for prosecution.
However, the court in this Mido case did not comprehensively judge the truth of all private life allegations surrounding Kim. The direct subject of the trial was strictly the issue of the return of the advertising deposit claimed by Mido against GOLDMEDALIST, and the core of the court's judgment was whether the grounds for contract termination were established. It is necessary to be cautious about over-interpreting this to mean that 'all allegations have been legally resolved' beyond the scope of the civil ruling.
This victory is also expected to be a subtle turning point in terms of Kim resuming his entertainment activities. After his domestic activities were significantly curtailed following the controversy, Kim has been showing signs of a comeback by participating in overseas advertisements and broadcasting schedules. It has also been reported that he is scheduled to appear in public in Korea for the first time in about 18 months at the end of August.
In particular, advertising is a field directly linked to a star's public credibility. While appearing in a production allows for rebuilding an image through a new character and narrative, advertising makes the actor the face of the product itself, meaning controversies can easily escalate into immediate economic disputes.
