Lawyer to Park Wi: 'Moral superiority just because you are vulnerable?'

As controversy continues over creator Park Wi releasing CCTV footage of a fall that occurred while disembarking from a KTX, a practicing lawyer has voiced a critical opinion regarding the method of disclosure and the subsequent response. The argument is that rather than focusing on the accident itself, one must examine whether it was appropriate for a party with massive online influence to release footage that allows the other party to be identified.

On the 24th, a lawyer posted a piece titled 'The reason we feel uncomfortable with Park Wi's video' on SNS, analyzing the matter from legal and social perspectives.

The lawyer first pointed out that based on the released CCTV footage, it is difficult to conclude that the social service agent's actions were intended to cause Park Wi harm. "The social service agent's action of pressing the footstool with their foot appears to have been an attempt to help Park Wi, rather than a deliberate act to cause injury," the lawyer explained. "The video captures the agent attempting to help Park Wi in some way even after the fall."

What the lawyer took issue with was the subsequent method of response. "The fact that the CCTV footage, which could specifically identify the individual, was released suggests an intent to have many people join in the criticism rather than serving a public interest," the lawyer argued. "It is effectively close to private sanction."

In particular, the lawyer noted the difference in influence within online spaces. Since Park Wi is a creator with numerous subscribers, a single video released by an individual can act as significant social pressure against the other party.

The lawyer also viewed the social service agent as someone who could fall under the category of a vulnerable social group deserving of protection. "A social service agent is also a member of the vulnerable social group in the broad sense of performing national defense duties," the lawyer noted. "It is excessively harsh for a person holding the massive influence of 1 million subscribers to 'archive' a video regarding an immature mistake without giving the person a chance to explain."

Following this, the lawyer strongly criticized, "It is a hypocritical standard—being lenient toward oneself while being infinitely strict toward others. We call this 'naeronambul' (double standards)."

The lawyer also argued that the core of the controversy should not be defined simply as a conflict between the disabled and the non-disabled. "I believe many people felt uncomfortable because they saw Park Wi attempting to secure unconditional moral superiority over others by using their identity as a member of a vulnerable social group," the lawyer emphasized, stating that more cautious judgment is required in the process of producing and releasing content.

The controversy intensified when Park Wi released a video titled 'The reason for releasing the CCTV footage' on his channel on the 21st.

The video contains a scene where Park Wi's wheelchair wheel gets caught by a social service agent's foot while descending a ramp after getting off the KTX. Regarding the situation at the time, Park Wi criticized the agent's behavior, saying, "The fact that the foot was placed on the ramp itself made me so angry."

However, following the release of the CCTV, criticisms arose that the method of disclosure itself was excessive, regardless of the circumstances of the accident. In particular, points were raised that releasing footage that could identify the other party's identity on a channel with a large subscriber base might exceed the scope of legitimate grievance.

Ultimately, as the controversy spread, Park Wi deleted the video and stated through an apology on the 22nd, "The method of delivery was immature and my thinking was short-sighted. I apologize to everyone who worked hard at the scene."

However, even after the apology, debates surrounding this incident continue online.

This dispute simultaneously poses important social agendas such as the right to mobility for the disabled and consideration, as well as the question of how far 'public exposure' in the SNS era can be justified. This is because as the boundary between public interest whistleblowing and online criticism of individuals, or between legitimate grievance and private sanction, becomes blurred, an individual's experience can move directly to a stage of public judgment.

Park Wi was diagnosed with quadriplegia following a fall in 2014 and has since recovered upper body mobility through continuous rehabilitation. Since then, he has continued activities to raise social awareness regarding disabilities by sharing his rehabilitation process and daily life as content. Park Wi married Song Ji-eun, formerly of the girl group Secret, in 2024.

This controversy ultimately converges on the point that the actions at the time of the accident and the subsequent method of disclosure must be viewed separately. A person's mistake being subject to criticism is not the same as placing that person on a public stand for judgment.
